Legal, Privacy & Demonstration Notice

HCMCx (the HCMC Digital Twin dashboard), including its software, visual design, interaction patterns, data models, scenario engine, and documentation, is the proprietary work of Dr Non Arkaraprasertkul and is presented as an Axiom concept demonstration prepared for VNTT and Becamex.

Unless expressly stated otherwise in writing, this dashboard is not an official product of the Government of Vietnam, Ho Chi Minh City People's Committee, or any public agency. Branding, corridor names, and map geography are used for demonstration and urban-intelligence illustration only.

No licence is granted to copy, redistribute, sublicense, or create derivative works from the dashboard codebase, design system, or curated datasets without prior written permission from Dr Non Arkaraprasertkul.

Data controller: Dr Non Arkaraprasertkul, reachable at non@nonarkara.org. This notice is issued under Thailand's Personal Data Protection Act B.E. 2562 (2019) (PDPA) because the controller operates from Thailand. It also serves as a transparency notice for visitors in Vietnam and elsewhere.

The public war room does not require login and does not deliberately collect names, national ID numbers, payment details, or contact information. Operational use is primarily read-only viewing of aggregated and modeled city intelligence.

Limited technical data may nonetheless be processed when you visit the site:

• Cloudflare Web Analytics — a cookie-free beacon that records anonymous page views, referrer URL, browser type, device class, and coarse performance metrics. Cloudflare processes this as a sub-processor under its Web Analytics terms.

• Session visit log — at most one request per browser session to a private logging endpoint, which may include page URL, referrer, user agent, screen resolution, browser language, time zone, and — when available from a third-party geo lookup (ipapi.co) — IP-derived country, region, and city. This supports demonstration reach analytics only.

• Local preferences — dark mode and language choice are stored in your browser's localStorage (keys: hcmc-dark-mode, hcmc-language). These never leave your device unless you clear site data.

Purpose: to operate and secure the demonstration, measure anonymous reach, and improve reliability. Legal basis: legitimate interest in operating a non-commercial concept demo with proportionate, minimal analytics; no profiling or automated decision-making with legal effect.

Retention: Cloudflare analytics are retained per Cloudflare's published schedule. Session visit logs are retained in a private spreadsheet until manually reviewed and deleted. Local preferences persist until you clear them.

Your rights under PDPA (and analogous rights elsewhere) may include access, correction, erasure, restriction, objection, and withdrawal of consent where applicable. To exercise these rights, email non@nonarkara.org with the URL visited and approximate date. We will respond within statutory timelines.

Cross-border transfer: hosting and analytics may involve servers outside your country (including the United States and Singapore via Cloudflare). Appropriate safeguards are relied upon through processor terms of service.

HCMCx is a concept demonstration dashboard. Metrics, alerts, corridor pressure scores, flood zones, metro ridership, flight boards, sensor readings, and decision-queue items may be labeled LIVE, MODELED, REFERENCE, SCENARIO, or UNAVAILABLE depending on the active data tier and configuration.

When the URL contains ?scenario=tourism-surge-weekend, ?scenario=red-monsoon-day, or ?scenario=stable-recovery-day, the system returns deterministic demonstration data across API routes. Scenario outputs are fictionalised operational pictures for workshop and pitch use — not forecasts issued by any authority.

This dashboard does not provide emergency, evacuation, medical, or engineering advice. Do not use it for life-safety decisions. In an emergency, contact official agencies: Vietnam emergency 113 (police), 114 (fire), 115 (ambulance), and local flood or traffic authorities.

News tickers, AI summaries, and anomaly flags synthesise open sources and rules-based logic. They may lag reality, omit context, or mis-rank severity. Always verify against primary official channels before acting.

Corridor traffic polylines on this deployment are MODELED typical rush-hour profiles (HCMC blackspots + Sở GTVT corridor anchors) — not live Google Routes. Legacy /api/google/* paths are stubbed and do not call Google Maps Platform.

When a TomTom API key is configured, live traffic flow segments are © TomTom and subject to TomTom developer terms.

Weather and air-quality layers use Open-Meteo (open licence). Google Air Quality API is disabled on this deployment.

Flight arrival boards may use AviationStack or curated reference schedules when live keys are unavailable.

Elevation, building footprints, and transit geometry may incorporate OpenStreetMap and other open geodata under their respective licences.

All third-party marks remain the property of their owners. This dashboard's arrangement, styling, and synthesis are proprietary to Dr Non Arkaraprasertkul.

By accessing HCMCx you agree to use it only for lawful, non-commercial evaluation of the concept demonstration unless otherwise agreed in writing.

The dashboard is provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, or non-infringement.

Dr Non Arkaraprasertkul and Axiom shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from use or inability to use the dashboard, including reliance on modeled or live feeds.

You may not scrape, bulk-download, or redistribute map tiles, traffic segments, 3D assets, or API responses except as permitted by the underlying data licences and written permission from the controller.

We may update this notice without prior notice. Continued use after changes constitutes acceptance of the revised notice.
